These Terms of Use (these "Terms") govern your access to and use of the website at vardoger.app, including its subdomains, documentation, blog, and downloads pages (the "Website"), operated by Vardoger Inc., a Delaware corporation ("Vardoger," "we," "us"). By accessing or using the Website, you agree to these Terms.

Scope. These Terms cover the Website only. They are one of three documents, each with a distinct scope:

• These Terms of Use — your use of the Website.
• The End User License Agreement — your installation and use of the Vardoger desktop application (the "Software"). Downloading the Software from the Website does not itself grant a license; the EULA does.
• Lemon Squeezy's terms of sale — your purchase of a license. Purchases on or via the Website are processed by Lemon Squeezy, LLC as merchant of record, and the purchase transaction is between you and Lemon Squeezy under its terms.

Our Privacy Policy describes how information is handled across all three contexts.

1. Eligibility

The Website is not directed at children. You may use the Website only if you are at least 16 years old and capable of forming a binding contract under the law applicable to you.

2. Intellectual Property

The Website and its contents — including text, documentation, graphics, logos, and design — are owned by Vardoger or its licensors and are protected by copyright, trademark, and other laws. We grant you a limited, revocable, non-exclusive license to access the Website and to view, download, and print its content for your personal or internal business use in connection with evaluating or using the Software. You may not otherwise reproduce, distribute, modify, or create derivative works of Website content without our written permission. "Vardoger" and associated logos are trademarks of Vardoger Inc.; nothing in these Terms grants you rights to use them.

3. Acceptable Use

You agree not to: (a) access the Website by automated means that impose an unreasonable load on our infrastructure, or scrape its content for republication; (b) probe, scan, or test the vulnerability of the Website or circumvent any security or access controls, except pursuant to a coordinated disclosure (see Section 4); (c) interfere with the operation of the Website or any other user's access; (d) misrepresent your affiliation with Vardoger; or (e) use the Website for any unlawful purpose.

4. Security Reports

We welcome good-faith security research conducted without harming the Website, our services, or our users' data. If you believe you have found a vulnerability, report it to security@vardoger.app. Do not access, modify, or exfiltrate data that is not yours, and give us a reasonable opportunity to remediate before public disclosure.

5. Downloads

Software made available for download on the Website is licensed, not sold, and is governed exclusively by the EULA. Release artifacts are cryptographically signed; verification instructions are provided in the documentation. You are responsible for verifying that you download Vardoger software only from vardoger.app or our official package repositories.

6. Third-Party Links

The Website may link to third-party websites and services, including cloud storage providers. We do not control and are not responsible for their content, terms, or privacy practices.

7. Documentation Is Provided As-Is

Documentation, blog posts, compatibility notes, and other informational content on the Website are provided for general information. While we aim for accuracy, we do not warrant that Website content is complete, current, or error-free, and it does not constitute professional advice. Features and compatibility described on the Website may change; the EULA governs what is actually licensed.

8. Disclaimer of Warranties; Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE WEBSITE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED; AND VARDOGER WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF, OR INABILITY TO USE, THE WEBSITE, AND VARDOGER'S TOTAL AGGREGATE LIABILITY ARISING OUT OF THESE TERMS OR THE WEBSITE WILL NOT EXCEED ONE HUNDRED US DOLLARS (US $100). FOR LIABILITY RELATING TO THE SOFTWARE, THE EULA — NOT THESE TERMS — APPLIES. Nothing in these Terms excludes or limits any right or remedy that applicable law does not permit to be excluded or limited.

9. Changes; Termination

We may modify the Website or these Terms at any time. Updated Terms will be posted at this URL with a revised "Last updated" date and apply to your use of the Website from that point forward. We may suspend or terminate access to the Website for any breach of these Terms.

10. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws rules. Subject to any non-waivable consumer protections applicable where you live, the state and federal courts located in Delaware have exclusive jurisdiction over disputes arising out of these Terms.
